Leading College Publishers Settle Trademark And Copyright Suit Against Valorebooks.com

NEW YORK, February 28, 2008 —Publishers McGraw-Hill Education, Pearson Education, Inc., John Wiley & Sons, Inc., and Cengage Learning, Inc. today announced they had settled a previously pending trademark and copyright infringement lawsuit against Valore, Inc., Valore Exchange, LLC, and Robert J. Brannigan, Jr., owners and operators of the online textbook marketplace, ValoreBooks.com. The lawsuit alleged that Valore’s website, www.valorebooks.com, repeatedly permitted and assisted sales by third-party sellers of pirated educational materials and foreign manufactured editions of textbooks not authorized for sale in North America, including editions bearing the publishers’ trademarks that are materially different from their authorized U.S. counterparts.

The publishers’ complaint, filed in U.S. District Court for the Eastern District of New York, alleged numerous violations of U.S. copyright and trademark laws, and sought to stop the unauthorized importation, promotion, advertising, sale, and distribution via Valore’s website of foreign manufactured editions of textbooks not authorized for sale in North America, as well as pirated electronic copies of the publishers’ works.

As part of the settlement, the Court entered a Consent Order prohibiting Valore from importing, purchasing, packaging, altering, marketing, offering for distribution or sale, selling or otherwise distributing, or contributing to the distribution of any of the publishers’ copyrighted textbooks and other foreign manufactured materials that are not intended for sale in North America or that bear the publishers’ trademarks and are materially different from their authorized U.S. counterparts. Valore is also prohibited from selling and distributing any pirated electronic copies of the publishers’ works. The parties agreed to keep the other terms of the settlement confidential.

“The complaint against Valore and this settlement underscore the firm commitment by these publishers to protect their own intellectual property rights and the rights of their authors,” said Ronald G. Dove, Jr., of Covington & Burling LLP, the law firm representing the four publishers in this suit. “Businesses and individuals should know that the publishers will continue to pursue legal action against those who violate their intellectual property rights, including those website operators who may not themselves directly infringe the publishers’ rights, but who provide internet marketplaces that permit and assist others in doing so.”

Separately, the publishers have filed multiple lawsuits against individual sellers on Valore’s website and other websites who have directly engaged in this illegal conduct. Those suits are either pending or settled at this time, and additional suits are expected to be filed in the future to safeguard the publishers’ intellectual property rights, as well as the rights of their authors and other constituents.
