Publishers Settle International Edition Textbook Selling Lawsuit Against Two Individuals Defendants Imported, Sold Unauthorized Copies of Non-U.S. Versions of Textbooks NEW YORK June 13, 2007 - Three leading college textbook publishers, Pearson Education, John Wiley & Sons, and Thomson Learning, today announced they have settled pending litigation against two defendants engaged in the importation, promotion and sale of non-U.S. versions of educational textbooks. The defendant advertised so that U.S. consumers thought they were purchasing authorized U.S. versions of the textbooks. . The publishers' complaints, filed in U.S. District Court of the Southern District of New York, alleged that defendants from Michigan and Singapore, doing business as "unlimitedgie," "allnewbook," "b3stbargain," and "getcheaptextbook," were responsible for the importation, promotion and sale of non-U.S. versions of educational textbooks not authorized by the publishers for sale and/or distribution within the United States. The defendants agreed to pay the publishers a significant settlement amount, to cease all importation, promotion and sales of the publishers' works, to recall any and all versions of the publishers' works, or any other materials or products that bear resemblance to publishers' works, and to turn over any remaining non-U.S. copies of educational material in their control or possession. "Textbook publishers will continue to pursue legal action against those who engage in unauthorized importation of textbooks not authorized for sale within the United States. Publishers will not tolerate the unlawful reproduction and sale of their intellectual property," said Georges Nahitchevansky, counsel representing all of the publishers.
