Publishers Settle Unauthorized Textbook Selling Lawsuit Against Two Individuals

Defendants Imported, Sold Unauthorized Copies of Non-U.S. Versions of Textbooks, Manuals

NEW YORK, October 17, 2006 – Three leading college textbook publishers, Pearson Education, John Wiley & Sons, and Thomson Learning, today announced they have settled pending litigation against two defendants engaged in the unauthorized importation, promotion and sale of non-U.S. versions of educational textbooks and the unauthorized reproduction of textbook solutions manuals.

The publishers’ complaints, filed in U.S. District Court of the Southern District of New York, alleged that individuals using the names “Dalbooks,” “Chitownbooks,” “Chitownbooksdot.com,” “Chitownbooks_com,” and “Easybooks_il” were responsible for the unauthorized importation, promotion and sale of non-U.S. versions of educational textbooks not authorized by the publishers for sale and/or distribution within the United States, and the unauthorized reproduction and sale of electronic copies of publishers’ instructor’s manuals.

“This is yet another important settlement for textbook publishers. We hope that these lawsuits and subsequent settlements send a strong message that publishers will not tolerate the importation of international textbooks not authorized for sale within the United States, the unlawful reproduction and sale of their intellectual property, or the distribution of materials that may impair the pedagogical efficacy of their textbooks,” said Georges Nahitchevansky, counsel representing all of the publishers.
